LTD as TELEPRAC (together with the Website, they may be referred to as the “Services”). 1. TERMINOLOGY USED IN POLICY: a. Cookies: It is a small file placed on your device by our website or mobile application when you either visit or use certain features of our website or mobile application. A cookie generally allows a website to remember your actions or preference for a certain period.
b. Data: Data includes non-personal information, personal information, and sensitive personal information about you, which either directly or indirectly in combination with other information, could allow you to be identified when you visit our website and/or mobile application.
c. User or you: A natural person who could access and use our website or mobile application d. Us, Our or We: It represents TELEPRAC and our designated personnel’s who could process your information.

TELEPRAC is available only to such natural persons who have agreed to the Terms of Use and Privacy Policy after obtaining due registration, in accordance with the procedure as determined by TELEPRAC from time to time and such Terms of Use, read together with the Privacy Policy, that govern your purchase and use of the products and services from TELEPRAC. TELEPRAC constitutes a legally binding contract, between you (“You” or “Your” or “Customer” or “User”) and TELEPRAC.
b. This Privacy Policy shall apply to the use of the Website/mobile application by all Users. Accordingly, a condition of each User (s) access to the Website/mobile application and to the other services provided by TELEPRAC to Users is their acceptance of this Privacy Policy. Every User is required to read and understand the provisions set out herein prior to submitting any sensitive personal data or information to TELEPRAC failing which they are required to leave the Website/mobile application.
c. Although, we have employed sensible security practices and procedures that are commensurate with the information assets being protected and with the nature of our business. While we try our best to provide security that is proportionate with the industry standards, because of the inherent vulnerabilities of the internet, we cannot ensure or warrant complete security of all information that is being transmitted to Us by You.
d. This Privacy Policy is published in compliance to the Information Technology Act, 2000 and the rules, regulations, guidelines, and clarifications framed thereunder, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

As a new User, when you register/create an account, upload your medical prescription, or place your order at TELEPRAC via our website/mobile application
b. As an existing customer, when you update your existing profile on TELEPRAC website.
c. As part of using the Website/mobile application, without predisposition to the generality of the above, information collected by us from you may include (but is not limited to) the following
- Name
- Email address
- Phone number
- Billing/Shipping address including your local pickup location
- User ID
- Gender
- Age
- Valid financial/payment information (managed by third party payment gateway)
- Password chosen by User (encrypted)
The Website uses temporary cookies to store certain data (that is not Sensitive Personal Data or Information) that is used by TELEPRAC for the technical administration of the Website/mobile application, research & development, and for user administration. The SPI Rules define "Personal Information" as any information that can be used, either directly or indirectly, in combination with other available or likely to be available information, to identify a natural person. The SPI Rules also define "Sensitive Personal Data or Information" as personal information about a person that relates to: passwords; financial information such as bank accounts, credit and debit card details, or other payment instrument details; physical, physiological, and mental health conditions; sexual orientation; medical records and history; biometric information; information received by a body corporate through lawful contracts or other means; visitor details provided at the time of registration or later; and call data records
4. OUR USE OF DATA: Any or all the above data collected from You may be required by Us from time to time to provide information related to TELEPRAC services and to work on the experience when using our website or mobile application. Specifically, data may be used by Us for the following reasons:

k. in connection with loyalty programs owned and operated by Us;
l. to enhance your consultation/ service shopping experience and bring you access to membership programs, rewards and offers from Us;
m. protect against and prevent fraud, illegal activity, harm, financial loss and other legal or information security risks.

4.3. We do not have control over the sites that are displayed as search results or links within our services. These other sites may place their own cookies or other files on the user's computer, collect data or personal information from the user, for which TELEPRAC is not responsible or liable. Therefore, TELEPRAC does not make any claims about the privacy practices or policies of these third parties or the terms of use of these websites, nor do we guarantee the accuracy, integrity, or quality of the information, text, sound, data, software, photographs, graphics, videos, messages, or other materials available on these websites. The inclusion or exclusion of a website does not imply any endorsement by TELEPRAC of the website, the website's provider, or the information on the website. 5. FOR REGISTERED MEDICAL PRACTIONERS (RMP’s):
5.1. It is important that all registered medical practitioners from here may be referred as RMP’s; read and understand the privacy statements in this Privacy Policy before submitting any personal or sensitive information to TELEPRAC. If a practitioner is unable or unwilling to do so, they must immediately leave the Services, including the Website
5.2. During the registration and profile setting process on the TELEPRAC dashboard, certain personal and sensitive information may be collected from practitioners as part of the application submission process.
5.3. At TELEPRAC, we use the personally identifiable information provided by practitioners, with their consent, to help them accurately and effectively describe and identify themselves on our platform. This information remains the property of TELEPRAC. As a practitioner, you will retain ownership of your information and consent to our collection, use, processing, and/or disclosure of this information for the purposes outlined in this agreement. TELEPRAC may use this information for commercial purposes and may also use it in an aggregated, non-personally identifiable form for research, statistical analysis, and business intelligence. We may sell or transfer this research, statistical, or intelligence data to third parties and affiliates in an aggregated, non-personally identifiable form. TELEPRAC also reserves the right to use information provided by or about practitioners for the following reasons: i. Posting information on the website for public access. ii. Reaching out to practitioners through registered phone numbers (registered with the DNC Registry) to offer new products or services and gather feedback iii. Analysing anonymous practice data, including financial and inventory information, for commercial purposes. iv. Examining software usage patterns to improve product design and functionality. v. Contacting practitioners to gather feedback on products or services.
5.4. The information listed on our website and mobile application for practitioners (referred to as "RMPs") is displayed to end-users when they search for doctors on our platform and is used by end-users to request appointments with RMPs. Any personally identifiable information of RMPs listed on our platform is not generated by TELEPRAC. RMPs are responsible for completing their profiles and providing the information that is displayed on our platform. It is important for RMPs to regularly check the accuracy and comprehensiveness of their information and to inform us immediately of any discrepancies, changes, or updates. While we cannot guarantee the accuracy of the information provided by RMPs, we will take reasonable steps to ensure that the information on our platform is comprehensive and accurate.
6. END-USERS NOTE: This section applies to all end-users who utilize our services
6.1. During the registration/signup or profile completion process for end-users on our website, we may collect certain information, including personal information or sensitive personal data or information, from end-users.
6.2. All end-users are required to read and understand the privacy statements outlined in this policy before submitting any personal information or sensitive personal data or information to TELEPRAC. If an end-user does not agree to these statements, they are required to leave our platform (website/App) right away. If you have submitted any personal information or sensitive personal data or information to TELEPRAC before reading our privacy statements and do not agree with how this information is collected, processed, stored, used, or disclosed, you have the option to access, modify, and delete this information through your profile settings on our website. Other information collected by TELEPRAC from end-users that does not personally identify them as an individual is owned by us. Specifically, TELEPRAC reserves the right to use anonymized end-user demographics and health information for the following reasons: i. Examining application usage patterns to enhance product design and functionality. ii. Using such information for research and development of new technical products for better healthcare solutions iii. Incorporating analysis of this information into other commercial product offerings and sharing analysis with third parties.
6.4. We may maintain records of electronic communications and telephone calls related to appointments or other administrative purposes for the purpose of providing customer support, conducting research and development, and improving the accuracy of our Practitioner listings. These records may include information such as the date and time of the communication, the parties involved, and the content of the conversation.
6.5. TELEPRAC may disclose or transfer the personal and other information of End-Users to a third party as part of a reorganization or sale of assets. If such a transfer occurs, the third party will have the right to use this information in accordance with the Terms of Use. In order to provide you/End-Users with the necessary Services, we may need to share your personal information with third-party contractors who work on behalf of or with TELEPRAC. These contractors may include those who assist with communication, website maintenance, or payment processing. These third-party service providers will only have access to the information necessary to fulfil their specific role and are not allowed to use it for any other purposes. However, some contractors who provide services on the Website, such as providers of online communication services, may have their own privacy policies that allow them to use and disclose personal information collected in connection with their services. In these cases, you/End-User consent to the disclosure of your personal information to contractors for the intended purposes only. Please Note: When booking appointments for minors, the parent or guardian is responsible for agreeing to all terms and conditions and adhering to the privacy policies. To ensure the correct information is recorded, we have a feature on the website that allows you to add family members to your profile and provide their name and details. If you failed to do so and under any circumstance there is a medico-legal case pertaining to misuse of the information or any misprint of prescriptions/diagnostic tests, you will be solely responsible for such discrepancies. TELEPRAC will not be held responsible for these actions under any circumstances.
7. KEEPING YOUR DATA SECURE: We are using technical and organisational measures to safeguard your data and we store your data on secure servers. Technical and organisational measures include measures to deal with any suspected data breach. We believe and respect your medical history files and other information and it’s our top priority to keep them safe. 8. WHO CAN ACCESS YOUR INFORMATION: Your personal identifiable information can be accessed only on a need-to-know basis by certain designated TELEPRAC employees who manage the database, and all such employees are bound to strict confidentiality obligations and have agreed to our data protection policy.
9. CONFIDENTIALITY OF YOUR MEDICAL RECORDS/PRESCRIPTIONS: We understand the confidential nature your prescription and your disease/condition and medications/diagnostic tests advised. Your prescription uploaded on our website/mobile application is treated as protected information at TELEPRAC. Your medical history created by the RMPs associated with TELEPRAC or your previous history uploaded on our website is also treated as protected information.
10. USERS RIGHT TO THEIR PERSONAL INFORMATION: a) All the information provided to TELEPRAC by a User, including any sensitive personal data or information, is voluntary. User has the right to withdraw his/ her/ its consent at any time, in accordance with the terms of this Privacy Policy and the Terms of Use, but please note that withdrawal of consent will not be retrospective. b) Users can access, modify, correct and delete the personal Information provided by them which has been voluntarily given by the User and collected by TELEPRAC in accordance with this Privacy Policy and Terms of Use. In case the User seeks to update or correct, his/ her personal information, the User may exercise these rights accessing their profile on website/mobile application. c) If a User has accidentally submitted any personal information to TELEPRAC prior to reading the Privacy Policy and Terms of Use, and such User does not agree with the manner in which such information is collected, stored or used, then such User can request TELEPRAC by sending an email to [email protected] for assistance applicable as per rules and regulation and our policies. d) In case the User does not provide his/ her information or consent for usage of personal information or subsequently withdraws his/ her consent for usage of the personal information so collected, TELEPRAC reserves the right to discontinue the services for which the said information was sought.
11. CHANGES IN PRIVACY POLICY: TELEPRAC may update this Privacy Policy at any time, with or without advance notice. We urge you to review it intermittently to ensure that you agree with any such changes that we make. We will make best efforts to inform you of any important amendments by e-mail, message on the Website or notifications in your account. However, it is your responsibility to check our policies regularly to ensure that you agree with us. Your continued use of the Website will be deemed to be your acceptance of any changes that we make even if the same are not informed to You by any reason. If a User uses the Website/mobile application, such User is hereby deemed to have provided his/ her consent to the changed/modified Privacy Policy.

Although the TELEPRAC Website and Services are not intended for use by minors, TELEPRAC respects the privacy of minors who may inadvertently use the internet or the mobile application.
